These Terms and Conditions, issued by Confezioni Peserico S.p.A. (the “Company”), govern the issuance, use, validity, and management of Gift Cards (“Gift Card”), available in the following formats: (i) physical (“Physical Gift Card”) and (ii) virtual (“Virtual Gift Card”).

Unless otherwise specified, the terms “Gift Card” or “Card” refer interchangeably to both types.

The Gift Card is a prepaid bearer payment instrument, usable exclusively for the purchase of Peserico-branded products at participating boutiques listed in the table below (the “Boutique”) or, for the virtual version, on the websites it.peserico.com, eu.peserico.com, and us.peserico.com (the “Sites”), according to the procedures set forth in this document.

The purchase, possession, or use of the Gift Card constitutes full and unconditional acceptance of these Terms and Conditions, here available, which integrate without replacing the Terms and Conditions of sale applicable to Peserico boutiques and e-commerce available at this URL ________________. For matters not expressly covered herein, reference is made to the Terms and Conditions and applicable laws, including consumer protection regulations. The Virtual Gift Card can be purchased on the Sites. The Physical Gift Card can be purchased at a single-brand boutique in Europe or the United States, as listed below:

The Gift Card allows the purchase of any product from the collections available (i) on the Sites, in the case of a Virtual Gift Card, or (ii) in one of the Boutiques, in the case of a Physical Gift Card. The Physical Gift Card can only be used within the country in which it was purchased. Therefore, Physical Gift Cards purchased in a boutique located in a certain country (e.g., Italy) cannot be used in a boutique located in a different country (e.g., Germany).

The Card’s value can be used in one or more transactions until fully spent. For Gift Cards purchased in boutiques, the amount is freely determined by the customer, with a minimum value of €50.00. For Gift Cards purchased on the Sites, the amount can be selected from predefined denominations available on the Sites.

The Gift Card can be purchased at Boutiques using accepted payment methods or online on the Sites, provided that it is not possible to purchase a Gift Card using other gift cards, discount vouchers, gift vouchers, or equivalent instruments.

The amount corresponding to the Gift Card does not accrue interest and cannot be converted into cash or refunded, except as required by mandatory applicable law.

The Gift Card is valid and usable only after activation, following payment of the corresponding amount for the chosen Card and its issuance.

• For Physical Gift Cards, activation occurs upon purchase and handover at the Boutique.
• For Virtual Gift Cards, activation occurs after payment verification. Confirmation of activation will be sent by email to the purchaser and, if indicated, to the recipent.

For Virtual Gift Cards purchased on the Sites, the Company is not responsible for non-receipt, activation failure, or delivery delays caused by factors beyond its control, including, but not limited to: (i) malfunctions or interruptions of telecommunication networks or systems; (ii) delays or loss of data due to the above; (iii) errors, incomplete or incorrect recipient data provided by the purchaser; (iv) non-delivery to the specified email address for reasons beyond the Company’s control; (v) automatic classification of emails as spam or junk.

The Gift Card is valid for 12 months from the date of activation, unless local law in the country of use provides for a different minimum validity period. In such cases, the Gift Card will remain valid for the minimum period required by the law of the country where it is used.

For Gift Cards purchased and/or used in the United States, the minimum validity period is determined by the state law where the purchase occurs and may differ from the standard period specified in these Terms. In accordance with federal law, validity cannot be less than five (5) years from the date of activation, unless otherwise required by specific state laws.

The Card may be used in one or more transactions up to its initial value.

Upon expiration the Gift Card cannot be used for purchases, renewed, or refunded; any remaining credit cannot be reimbursed, re-credited, or converted to cash, nor give rise to any compensation, except as required by mandatory law.

If the purchase price exceeds the remaining Card balance, the difference can be paid using the payment methods accepted in Boutiques and/or on the Sites. Payment may therefore be combined between the Gift Card and other available methods.

The Gift Card balance can be checked at any time until expiration at any Boutique or, for Virtual Gift Cards, on the Sites, according to the procedures indicated.

The Gift Card is not nominative and may be used by anyone presenting it. The holder is solely responsible for its safekeeping and correct use. Lost, stolen, or damaged Cards will not be replaced or refunded.

Gift Cards acquired or used through fraudulent, illegal, or otherwise non-compliant conduct may be suspended or cancelled. The Company reserves the right to report such cases to authorities after necessary verification.

The Gift Card cannot be used for advertising or promotional purposes without prior written authorization from the Company.

The Gift Card is solely a payment instrument and does not constitute an investment, financial product, or solicitation for public savings.

To use a Physical Gift Card, the holder must present it at the time of payment at authorized Boutiques. Only for Virtual Gift Cards are printed copies or electronic presentation accepted.

These Terms and Conditions are valid from the date of publication on the Sites and in Boutiques. Updates or amendments will be effective from the date of publication.

Purchase and use of the Gift Card are governed by the version of the Terms and Conditions in force at the date of purchase.

APPLICABLE CONDITIONS TO EU CONSUMERS

For Virtual Gift Cards purchased online on the Sites, consumers have a right of withdrawal within 14 days of purchase, provided the Card has not been used, even partially, before exercising the right of withdrawal.

If withdrawal is validly exercised, Peserico will refund the amount paid using the same payment method, unless otherwise agreed.

For purchases made in Boutiques with a Physical Gift Card, (i) the laws of the country where the Boutique is located apply; (ii) the specific Boutique’s return policy applies.

If a product purchased with a Gift Card is returned:

• Return made within the original Gift Card validity (12 months): the refunded amount will be recredited to the same Card up to its available value.
• Return made after the original Gift Card expiration but within the 13th month: a new Virtual Gift Card equal to the refunded amount will be issued automatically, valid for 30 days from the date of issuance.
